Forensic Economic Analysis
We analyze damages issues in cases involving claims associated with personal injury, wrongful death, medical malpractice, and employment disputes. A significant part of that work involves analyzing the reports of opposing experts.
As experts in evaluating the economic damages associated with these claims, we can determine the present values of lost earning capacity, lost wages, loss of economic support, loss of household services and future medical costs. We are also experts at evaluating damage models associated with loss of “value of life” (also called hedonic damages).
Our love for research and data, combined with our knowledge of relevant economic theory, literature and data sources, allows us to look deeply into the questions relevant to each case. Rigorous, reproducible analyses always underlie our opinions.
Commercial Disputes
Each business is unique – and so is each dispute. Dr. Hunter has developed damages models based on sales lost due to torts, breach of contract, patent infringement and anticompetitive behavior. His experience spans a wide range of industries, including medical devices, pharmaceuticals, payment systems, online platforms, transportation, agricultural markets, consumer products, labor markets, financial markets, equipment leasing, software, mining, music and entertainment and tobacco.
Intellectual Property
We have extensive experience in intellectual property matters. Dr. Hunter has assisted clients in both litigation and rate setting proceedings, and assisted one of the nation’s largest performing rights organizations in multiple matters about reasonable royalty rates. He has worked on patent infringement litigation for both plaintiffs and defendants.
Bankruptcy
We provide analysis and expert opinions on the appropriate “cramdown” rate when a restructuring plan is opposed by one or more classes of creditors. We also provide analyses of opposing experts’ opinions.
Competition and Antitrust
Dr. Hunter has evaluated issues surrounding claims of anticompetitive behavior, from defining relevant antitrust markets and assessing market power, to assessing injury and calculating damages resulting from its unlawful exercise. His experience includes addressing allegations of price fixing, market manipulation, exclusionary conduct, and bundling on behalf of private clients (both plaintiffs and defendants) and the government. He has guided clients in the merger review process, including assisting with second request compliance, and participated in the prosecution of, and defense against, applications for preliminary injunctions.
